Eligibility to apply for payment

Workers and family members of workers who died due to work accidents or occupational diseases who are not able to settle the labour claims, in whole or in part, through judicial proceedings can submit an application to the Fund for the payment of those claims. The application form and therequired documents must be submitted in person at the Fund.

If the applicant submits the application before having the court decision and the statement on the debtor's lack of assets, the procedure will be suspended. However, the applicant may, within the periods listed in the table below, request to the Fund for an advance payment not exceeding half of the labour claim amount. The remaining payment of the labour claim will only be settled after the submission to the Fund of the court decision and the statement on the debtor's lack of assets.

2. Photocopy of the applicant's identity document (as well as presentation of the original)

If the applicant is a local resident, a photocopy of the Macao Resident Identity Card must be submitted; if the applicant is a non-resident worker, a photocopy of the Non-resident Worker Identification Card (blue card) must be submitted.

3. Court decision

The applicant can submit the application before having the documents, but the procedure will be suspended until the submission to the Fund. However, the applicant can apply for advance payment if the requirements are fulfilled.

If the application is made by a third party, the following documents must also be submitted:

● Document attesting the representation (certified power of attorney in case of proxy; photocopy of court decision in case of lawful representative).

Procedure

Reimbursement obligation

The applicant is required to reimburse to the Fund when:
● the debtor pays the amounts claimed;
● the amount paid by the Fund exceeds the amount the applicant is entitled to, namely when the court rules the claim as non-existent, or settles the claim amount at a lower value than the amount paid by the Fund.

The reimbursement to the Fund must be made within 45 days from the first of the following occurrences:
● Settlement of claims by the debtor;
● Issue of court decision;
● Issue of reimbursement notice by the Fund in other situations.

If the reimbursement does not take place within the aforementioned period, the Fund will send the relevant information to the Financial Services Bureau for compulsory collection. The non-reimbursement is an administrative offence punished with a fine equal to 25% of the amount to be reimbursed.
